Complex Commercial Litigation & Arbitration

SBR frequently represents investors, venture capitalists, private equity funds, hedge funds, family offices and other institutions in a wide variety of business disputes brought in courts and arbitration forums around the country. We regularly represent entrepreneurs and company founders in disputes over earn-outs and milestone payments, successfully demonstrating that acquirers have misrepresented earnings or results in order to try to reduce or avoid such post-closing payments. We have litigated unfair competition claims to protect the proprietary information of private equity firms. We are also frequently hired by leading law firms from around the world to assist foreign litigants in obtaining discovery in the United States.

SBR represents entrepreneurs, domestic and foreign companies, and individuals in a diverse range of complex commercial litigation and arbitration in state and federal trial and appellate courts and before FINRA, the American Arbitration Association (“AAA”), and other arbitral bodies. The firm’s victories in commercial litigations and arbitrations include multi-million dollar arbitral judgments secured after trial against some of the world’s largest financial institutions. We have also won multi-million dollar recoveries for entrepreneurs who sold their businesses to Fortune 500 corporations that violated their financial obligations to SBR’s clients.

SBR is also a leading advocate on behalf of victims of terrorism. The firm’s partners led the successful efforts to collect $1.9 billion from Iran’s central bank in a case arising from the 1983 bombing of the Marine Barracks in Beirut, Lebanon. In that case, SBR successfully argued on behalf of the plaintiffs in the Court of Appeals for the Second Circuit and assisted with the plaintiffs’ successful efforts in the United States Supreme Court. SBR partners also served as part of a trial team that secured the first ever jury verdict against a financial institution for providing material support to terrorist organizations.

The firm’s partners possess substantial expertise handling the unique challenges of representing foreign clients and domestic clients involved in a variety of international disputes. The firm is a founding member of the World Investor Lawyer Network (WIN), a coalition of law firms that works to ensure the integrity of global markets.* SBR’s membership in WIN enables us to work cohesively with top law firms in Europe and elsewhere to develop innovative solutions for litigating and resolving international disputes.

In many matters, we have utilized bilingual attorneys and document translators to help us evaluate, investigate and litigate cases presenting international implications. Non-U.S. lawyers, law firms, and companies frequently retain SBR to assist with international investigations. SBR is also a leader in pursuing domestic discovery related to litigation pending outside the United States.

All of our partners possess more than 20 years of experience representing clients’ interests at every stage of the litigation and arbitration process, from pre-suit investigation through trial and appeal. Because of the firm’s vast experience handling complex commercial litigations and arbitrations, we receive many referrals from other attorneys and former clients, and our attorneys are often chosen as lead counsel in class actions.
